Avoiding Trademark Infringement

Are you about to start new operations, introduce new products or expand your business and are keen to avoid trademark infringements?

To avoid trademark infringement, you should investigate the trademark landscape in good time. We can help you by providing a customized trademark search and assessment. As a rule, we begin by defining the extent of the search in the relevant trademark registries and corporate registries. The aim is to determine just how broadly a similarity search needs to be conducted. It is also important to determine the geographical range.

In addition to a German trademark search, we can conduct European or international trademark searches. These often involve continuous approaches to cover the home market as a start, for example, and keep costs low. A trademark search includes an assessment of those trademarks which have been found in order to determine, for example, whether use of the intended trademark poses a risk under trademark law and how high this risk might be. If there are evident risks, for example of infringement upon an older trademark, we provide timely advice on how to reduce or avoid the risk of trademark infringement and recommend supporting measures. In these cases, strategies to Remove or Bypass Third-Party Trademarks should also be taken into consideration.

After evaluating potential trademark infringements and determining measures to remove or bypass third-party trademarks, we can seek trademark protection by submitting a Trademark Application.

Registering a trademark not only provides protection against emulators; it can also prevent third-party trademark applications from impeding your own activity.
